New opposition register: how it works, what changes and since when

In fact, according to the official news issued by the Government, from this year also the mobile numbers they will be able to register to avoid being called by various switchboards which very often do nothing but disturb. Today the measure signed last January laying down provisions on the establishment and operation of the public register of contractors who oppose the use of their personal data and their telephone number for sales or commercial promotions. Basically, the new opposition register. They will be reported on this register all fixed and mobile numbers (the latter is the novelty) who will no longer want to be disturbed by unwanted calls.

However, if the provision comes into force today, it is from 31 July next that we will see the news to all intents and purposes. Basically, between July 31 and August 1, the service will be expanded in whole. So the automatic and non-automatic calls will be blocked if we are registered in the opposition register.

How the new opposition register works

Article 7 of the decree says how it works the opposition register. Here is what is important:

Each contractor may ask the registry manager that the numbering of which he is the holder [...] or the corresponding postal address [...] are entered in the register to oppose the processing of such data for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication, carried out through an operator using the telephone or paper mail as well as [...] through automated call systems or calls without an operator

How to register for the new opposition register

For the moment, only news "in general" has been released. More specific provisions will follow. We know there will be three modes to register:

  • by filling in a specific electronic form on the website of the registry
  • by call, made from the telephone line with a number corresponding to that for which registration in the register is requested
  • by e-mail

Of course, the electronic form, telephone number and e-mail address will be communicated later, no later than July 31st.

Some underlying problem

However, there are some basic problems. There slowness of bureaucracy will not allow the guarantors to arrange fines for offenders. This could in fact lead to a discouragement of users in reporting and then letting go. In this case, the whole system that has been studied for some years now would fail. We recall in this regard that the last law for personal data breaches was created in 2016.

A second problem is then that of calls from countries outside the European Union. Will these be fined?

And even if that were the case, users unable to communicate their dissent, how could they be facilitated to do so. In fact, if we think about the good chunk of users over sixty who use a smartphone, it is easy to think that they are not able (unless they are helped) to register in the new opposition register.

In short, there are still many doubts we have and we hope that by the deadline of 31 July those in charge will come forward to remedy. Personally we are very happy with this step forward, even if something less could have been done Italian and more complete.
