The right to repair becomes law. Will Italy stand by and watch?

Mobile and non-mobile devices are constantly evolving, and with them new problems and challenges emerge. California has recently taken significant steps to recognize and regulate the right to repair. The Californian Governor Gavin Newsom signed the law SB 244, better known as "Right to Repair Act” (Right to Repair Act). This facilitates the practice of repairing devices by the owners themselves or by independent repair shops. This law, also supported by iFixit, could have positive repercussions for consumers across the United States given California's huge economy.

The new legislation is stricter than some of the previous laws. Manufacturers are responsible for making appropriate tools, parts, software and documentation available for seven years after production for devices priced over $100. As for the less expensive devices, these must have the same materials available for three years.

However, the European Union he started steps to make the right to repair more accessible to citizens. The European Commission has adopted new rules that aim to ensure that numerous products are easier to repair and recycle, thus increasing their lifespan and reducing electronic waste. In 2022 however, the first step has been taken in the right to repair in Europe.

In the absence of a national law on the subject, Italians therefore find themselves waiting for the direct application of European regulations. The situation could stimulate a more in-depth debate and investigation in Italy, perhaps leading, in the future, to the formulation of clearer and more defined legislation at a national level that can guarantee Italian consumers a broad right to repair.
