Xiaomi has filed an invalidation application for several of Huawei's patents

The patent battle between Xiaomi e Huawei it intensifies. Xiaomi has in fact today filed an invalidation request for several patents of Huawei including that relating to a screen lock method and a mobile terminal. The patent is one of the four patents that Huawei has accused Xiaomi of infringing in an administrative lawsuit filed in February this year.

The State Intellectual Property Office has issued an announcement showing that the process date for the invalidation request is July 21st. This is Huawei's fourth patent that Xiaomi seeks to invalidate, after filing invalidation claims for three other patents involved in the lawsuit, which relate to 4G/LTE technology and the mobile phone camera.

The patent dispute between Xiaomi and Huawei it has been going on for a long time and is mostly about essential and non-essential technologies by industry standards. Essential technologies are those that are required to implement a technical standard, such as 4G/LTE technology, and are subject to fair, reasonable and non-discriminatory licensing obligations (FRAND). Non-essential technologies are those that are not required by a standard, but may offer additional benefits, such as cell phone camera and unlocking technologies.

The two sides said they are actively negotiating the patent licensing and are trying to use various mediation mechanisms to resolve the issue. However, the oral trial shows that the dispute has not yet been satisfactorily resolved and that the positions of the two sides are still divergent.

The patent infringement lawsuit between Xiaomi and Huawei reflects the growing competition in the smartphone market in China and around the world. Both companies are among the leading smartphone makers globally and are looking to expand their market share and technological influence. Intellectual property protection has become a key factor in ensuring the competitive advantage and innovation of smartphone companies.

According to data from the International Data Corporation (IDC), in the first quarter of 2023, Xiaomi surpassed Apple and ranked second in the global smartphone ranking with 16,6% market share, while Huawei ranked in sixth place with a share of 4,9%. The patent infringement lawsuit could have a significant impact on the two companies' performance in the smartphone market.
